Our Team

Louis Mostyn, QC

Born in the heartland of Ontario, in the town of Midland, in 1932, Louis received his Bachelor of Commerce (Honours) from the University of Toronto in 1955. He continued his studies at Osgoode Hall Law School and was called to the Bar in the Province of Ontario in 1959.

He received his Masters of Law from Osgoode Hall Law School in 1980, with a focus on Commercial Law. After years of distinguished service as a member of the Ontario Bar, he was also appointed Queen’s Counsel in 1980. He was presented in 1991 his LL.B.  from Osgoode Hall Law School, in recognition of his previous studies.

He is a life member of the Law Society of Upper Canada

Louis Mostyn has litigated at all levels of trial and appeal court in Ontario. He has had a varied practice throughout his career, and now focuses on civil litigation, insurance litigation, personal injury, motor vehicle insurance, professional negligence, and wills and estates.

Tony Afecto

Born and raised in Kingston, Ontario, Tony attended Queen’s University where he received his B.Sc in 1998. Tony was called to the Bar in the Province of Ontario in 2000.

Tony has a rich and varied practice where he focuses on civil litigation, insurance litigation, long-term and short-term disability claims, employment law, slips & falls claims, traumatic brain injury claims, car accident claims, wrongful death claims, life insurance claims (other types of personal injury claims), professional negligence, matrimonial and family law, business immigration and wills and estates.

He has argued matters of all sorts including both jury and non-jury trials, at various levels on Court including the Ontario Superior Court of Justice, the Ontario Divisional Court, the Ontario Court of Appeal, and the Federal Court of Appeal of Canada. Tony has also appeared frequently at Administrative Tribunals including Financial Services Commission of Ontario and the Workplace Safety & Appeals Tribunal.

Nelson Vu

Nelson has worked for the firm for more than twenty four years as a Business Development Manager. He has experience in personal injury and also helps the firm with business immigration and skilled workers’ immigration issues. Nelson has an engineering and telecommunication background.

In his spare time, Nelson enjoys boating and fishing.

Debra Carew

Raised in Toronto, Debra attended Humber College, Seneca College and the University of Toronto and obtained Honours Diplomas in Community Studies and Legal Administration.

She has worked at Mostyn & Mostyn for over 30 years, as a legal assistant on personal injury claims, matrimonial and family law and wills and estates. In addition, Debra has attended at numerous examinations for discovery, mediations, arbitrations, tribunals, pre-trials and trials.

Khorshed Alam

Khorshed has been working in the legal industry since 2009, working in various capacities including Business Management and Business Services. He has a Masters in Marketing with many years’ experience working with Multinational operations.

Khorshed’s core responsibilities are overseeing firm-wide activities including procurement, human resources management, annual budgeting, office payrolls, office services and records management, equipment maintenance and purchasing.

In his spare time, Khorshed enjoys instructing accounting software like AccPac, Simply Accounting and Quickbooks .

Manitoba Provincial Business Investor Stream – Entrepreneur Pathway


Business Investor Stream – Entrepreneur Pathway

Criterion


Minimum Requirement


Business Experience Minimum of three years of full time work experience in the past five years either as an active business owner or working in a senior management role of a successful business.
Business owners are given higher points in comparison to senior managers.
Business owners must have at least 33 1/3% ownership to qualify for points.


Official Languages Proficiency Minimum IELTS or CLB/NCLC 5


Education Minimum Canadian high school certificate equivalent


Age No minimum or maximum age; however, ranking points are allocated to candidates 25 to 49 years of age.


Business Investment Minimum investment is $250,000 for businesses situated in the Manitoba Capital Region.
Minimum investment is $150,000 if a business is situated outside of the Manitoba Capital Region.
Business Investment must be made in an eligible business as defined by the MPNP.
The proposed business must create or maintain at least one job for a Canadian Citizen or a Permanent Resident in Manitoba (excluding owners of the business and/or their close relatives).


Business Research Visit A Business Plan is required and is an integral part of the application.
A business research visit allows the applicant to conduct extensive research of their future business investment or proposal. The Business Research Visit must be conducted no more than one year prior to the submission of your EOI.


Adaptability Points will be allocated to you if:

  • Your spouse has IELTS or CLB/NCLC 5 or higher;
  • You or your spouse have CLB/NCLC 5 or higher in the Second Official Language;
  • You or your spouse or common-law partner have a close relative currently residing in Manitoba  for more than one year;
  • Your child is enrolled in an accredited Manitoba educational institution and is actively pursuing academic, professional or vocational training on a full-time basis for at least six months prior to the date of submission of EOI; and/or
  • You or your accompanying spouse or common-law partner have completed a program of full-time study for at least one year at a post-secondary institution in Manitoba. You or your accompanying spouse or common-law partner must have done this after you turned 17 years old and with a valid study permit;
    OR
    You or your accompanying spouse or common-law partner have completed at least six months of continuous full time employment in Manitoba. A letter of reference from the employer and a copy of the work permit must be provided.

Net Worth Minimum of $500,000
Your personal net worth will be verified by a third-party supplier approved by the MPNP. A verification report, along with the application, must be submitted to the MPNP within 120 days of receiving your LAA.


Business Performance Agreement After an application is approved, a Business Performance Agreement (BPA) must be signed prior to the MPNP issuing you a letter of support for applying for a work permit.


New Brunswick Provincial Business Investor Stream – Entrepreneur Pathway


Entrepreneur Stream

Criterion


Minimum Requirement


Business Experience – Minimum of three years of full time work experience in the past five years either as an active business owner. Business owners must have at least 33.3%, personally involved in the day-to-day operations as the primary decision maker, responsible for supervising at least two people.
or
–    Working in a senior management role of a successful business. Senior manager, personally involved in the day-to-day operations as a primary decision maker responsible for supervising at least two people. Minimum of 5 years of full time work experience in the past five years to get points.


Official Languages Proficiency Minimum CLB/NCLC 5 .


Education Minimum Canadian high school certificate equivalent. Ranking points are allocated to candidates who have higher education.


Age You must be between 22-55 years of age.


Business Investment Must have a minimum of 33.33 percent ownership and assume an active senior management role in the day-to-day operation of the business.
Make a minimum investment of $250,000 CAD before tax into eligible businesses required by the province.


Business Research Visit and Business Plan A business research visit allows the applicant to conduct extensive research of their future business investment or proposal. The Business Research Visit must be conducted no more than one year prior to the submission of your Expression of Interest (EOI).


Adaptability Points will be allocated to you if:

  • Your spouse has CLB5 or higher in English or French;
  • Completed at least six months of continuous full-time employment in New Brunswick.
  • Completed a program of full-time study of at least one year at a recognized post-secondary institution in New Brunswick after the age of 17 years and with a valid study permit.

Net Worth Have a minimum verifiable personal net worth of $600,000 which has been accumulated through legal and legitimate sources in your own right.  At least CAD $300,000 of your personal net worth is readily transferable and available and completely unencumbered by debts and/or other obligations.


Escrow Agreement Sign an escrow agreement with the province and submit a $100,000 deposit.
Within the three years following your landing date in New Brunswick, or one year after the business commencement date (whichever date comes first), you will be eligible to apply for a refund and return of your deposit of CAD $100,000, without interest, providing you fulfill the terms and conditions as set out in the signed and dated Business Performance Agreement.


Permanent Residency If you are selected for nomination by New Brunswick, you must then submit your application for
Permanent residency to the Federal Government.


Prince Edward Island (PEI) Provincial Business Investor Stream – Entrepreneur Pathway


Business Investor Stream

Criterion


Minimum Requirement


Business Experience Minimum of three years of full time work experience in the past five years either as an active business owner or working in a senior management role of a successful business.
Business owners must have at least 20% ownership to qualify for points.


Official Languages Proficiency Minimum band score of 4.0 on an IELTS test


Education Minimum Canadian high school certificate equivalent. Ranking points are allocated to candidates who have higher education.


Age Ranking points are allocated to candidates 22-54 years of age.


Business Investment Make a minimum investment of $150,000 CAD into a new or existing PEI owned and operated business.


Business Research Visit A Business Plan is required and is an integral part of the application.
A business research visit allows the applicant to conduct extensive research of their future business investment or proposal. The Business Research Visit must be conducted no more than one year prior to the submission of your Expression of Interest (EOI).


Adaptability Points will be allocated to you if:

  • Your spouse has CLB7 or higher in English or French;
  • Dependent child/ren enrolled in an educational institution in PEI for a minimum of 6 months
  • Spouse/partner attended a post–secondary institution in PEI
  • Spouse/partner has a minimum of 3 years work experience in the past 5 years
  • Close family member(s) who are PR or Canadian citizens living in PEI for at least 12 months (parent, grandparent, child, aunt, or uncle)
  • Experience in agriculture and plan to operate a farm in PEI

Net Worth Have a minimum verifiable personal net worth of $600,000 which has been accumulated through legal and legitimate sources in your own right.


Escrow Agreement Sign an escrow agreement with PEI province and submit a $200,000 deposit, which will be refunded upon you meeting the terms and conditions of the escrow agreement. Generally, $25,000 CAD will be refunded after six months of residence in PEI, another $25,000 CAD after one full year of residence, and the remaining $150,000 CAD once the applicant has met all terms of the escrow agreement


Permanent Residency If you are selected for nomination by Prince Edward Island, you must then submit your application for
Permanent residency to the Federal Government.


BC PNP – Entrepreneur Immigration

The following criteria must be met before a candidate may move forward with an application:

  • Minimum personal net worth: $600,000.
  • Minimum investment required: $200,000
  • Three years of business ownership & management experience OR four years of senior management experience OR one year of business ownership & management experience and two years of senior management experience
  • Business plan required.
  • No government deposit required
  • Performance agreement required in order to obtain a work permit: If the requirements are met within 20 months, the BC PNP will nominate the individual for permanent residence.
  • Exploratory visit not required, but strongly encouraged.
  • Interview with a British Columbia Provincial Nominee Program (BC PNP) officer required upon BC PNP’s request.
  • Sufficient language proficiency in English and/or French required.
  • Participation in day-to-day management of business required.
  • Additional selection criteria.

NSNP Entrepreneur Stream

The following criteria must be met before a candidate may submit an Expression of Interest:

  • Minimum personal net worth: $600,000.
  • Minimum investment required: $150,000.
  • At least 3 years of business ownership experience including 33.3% ownership OR more than 5 years as senior manager, both in the past 10 years.
  • Business plan required.
  • Participation in day-to-day management of business required.
  • Interview required.
  • Submission of an Expression of Interest (EOI) required.
  • Exploratory visit required for business succession only.
  • Additional selection criteria.

Quebec Entrepreneur

The following criteria must be met before a candidate may move forward with an application:

  • Minimum personal net worth: $300,000.
  • Minimum investment required: at least 25 percent of the capital equity of the business with a minimum value of $100,000.
  • Minimum two years of business management experience, having controlled at least 25 percent of the business’ capital equity, in the five years prior to submitting an application.
  • No government deposit required.
  • In-person interview required.
  • Points for language proficiency in French.
  • Participation in day-to-day management of business required.
  • Additional selection criteria
